Scope of a Custom Project

When an order is customized, the targeting criteria stated in the final written quote, invoice, proposal or order confirmation define the agreed project.

Customers should review those criteria carefully before approving or paying for the order and tell us promptly if anything needs to be corrected.

Data License and Permitted Use

Unless a written agreement states otherwise, a purchase from Family Office Prospects provides the customer with a limited business-use license to use the delivered dataset for the customer's own legitimate internal business activities.

YOUR DATA LICENSE

You may use purchased data for legitimate internal B2B activities.

This may include appropriate sales prospecting, business development, market research, event outreach, investor or professional outreach, CRM enrichment and related internal business activities, subject to applicable law and the terms of your order.

Internal Use

Data may generally be used by employees, officers and authorized contractors or service providers acting on your behalf where access is reasonably necessary for your permitted business purpose.

You remain responsible for ensuring that anyone receiving the data on your behalf uses it consistently with these terms and applicable law.

No Transfer of Our Intellectual Property

Purchasing a dataset does not transfer ownership of Family Office Prospects, our website, research methodology, proprietary data compilation processes, database structure, sample formats, written content, branding or other intellectual property.

The license relates to permitted use of the information delivered to you and does not transfer ownership of our underlying systems or proprietary research materials.

Prohibited Uses

Our data and services must be used responsibly. Unless we expressly agree otherwise in writing, you may not use our website, services or delivered information for any of the following purposes.

  • Sending communications in a way that violates applicable marketing, privacy, telecommunications, consumer-protection or data-protection laws.
  • Ignoring a recipient's applicable suppression, unsubscribe or opt-out request.
  • Removing proprietary notices from materials where those notices are intended to remain.
  • Using our website or systems in a way designed to interfere with security, availability or normal operation.
IMPORTANT A data license does not give permission to contact every person in every manner.

The customer must independently determine whether a particular communication, channel and use is permitted under the laws and rules applicable to the customer, recipient and relevant location.

Customer Responsibilities and Outreach Compliance

Family Office Prospects provides business data and related research. You control how the information is used after delivery, including the content, timing, audience and communication channels of your campaigns.

You are therefore responsible for ensuring that your use of the data complies with laws, regulations, industry rules and recipient preferences that apply to your organization and outreach activities.

Orders, Pricing and Payment

Quotes and Pricing

Pricing may depend on the size, complexity, geography, role criteria, data fields and research requirements of a project.

The price shown in your final quote, invoice or written order confirmation is the price applicable to that order, subject to any taxes, transaction charges or other amounts specifically disclosed.

Payment

Unless we agree to different payment terms in writing, payment is due according to the invoice or order instructions provided to you.

Custom preparation or final delivery may begin after payment has been received or otherwise confirmed, unless different arrangements are stated in writing.

Billing Information

You are responsible for providing accurate billing and contact information. If an invoice or order contains an error, please notify us before payment whenever reasonably possible.

Taxes

The customer is responsible for taxes, duties or similar governmental charges that apply to the purchase, except taxes imposed directly on our income, unless applicable law provides otherwise.

Delivery, Record Counts and Data Fields

Electronic Delivery

Data products are generally delivered electronically in a commonly used spreadsheet, CSV or another agreed digital format.

Delivery Times

Any delivery date or timeframe we provide is an estimate unless we expressly confirm in writing that a specific date is guaranteed.

Custom research may require additional time where criteria are complex, information needs further review or the project scope changes after work begins.

Estimated Record Counts

Pre-order record counts may be estimates. Actual deliverable counts can change during final research, duplicate review, verification, removal of records that do not meet the agreed criteria or other quality-control steps.

Fields “Where Available”

A field described as “where available” is not guaranteed to be populated for every record. Availability can vary by person, organization, geography and source.

Samples

A sample is intended to demonstrate the general structure, types of fields and targeting approach of a database. Unless specifically stated otherwise, it does not guarantee that every field shown in the sample will be available for every record in the final delivery.

Data Quality, Verification and Corrections

Professional information changes over time. People change jobs, organizations merge, domains change, telephone numbers are reassigned and publicly available information can become outdated.

We use research and quality-review processes designed to improve the relevance and usefulness of the information we provide, but no business database can be guaranteed to remain complete, current or accurate indefinitely.

If You Identify a Data Issue

If you believe a material portion of a delivered database does not match the written targeting criteria for your order, contact us promptly and provide reasonable examples so that our team can review the issue.

Cancellations, Refunds and Custom Orders

Many of our products involve digital delivery, custom targeting or research performed specifically for an individual customer. For that reason, cancellation and refund treatment can differ from ordinary physical goods.

Before Custom Work Begins

If you need to cancel or change an order, contact us as soon as possible. If preparation has not yet begun, we will review whether the order can be changed or cancelled.

After Preparation Has Begun

Once custom research, audience preparation, verification or other substantive work has begun, an order may no longer be cancellable because resources have already been committed to the requested project.

After Digital Delivery

Because a delivered digital database can be copied and used immediately, delivered data products are generally non-returnable and non-refundable except where required by applicable law or where our written order terms expressly provide a different remedy.

Data Quality Issues

A legitimate data-quality concern should be handled through the review and correction process described above. Where replacement, correction, credit or another remedy is specifically stated in your order, that written commitment will apply.

For custom database projects, the best way to avoid misunderstandings is to confirm the geography, roles, organization types, volume and required fields before approving the order.

Intellectual Property and Website Content

The Family Office Prospects website and materials we create may include proprietary or protected content such as our branding, graphics, written content, page designs, research materials, database organization, reports, sample formats and other original materials.

Except for the limited rights necessary to use a purchased product or service, no ownership or intellectual-property rights are transferred to you.

Service Availability

We do not guarantee that our website or services will be uninterrupted or error-free at all times. We may carry out maintenance, security work, updates or operational changes when reasonably necessary.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Family Office Prospects will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost opportunities, lost revenue, loss of goodwill or loss of data arising from or related to the use of our website, products or services.

Governing Law

Except where mandatory law provides otherwise, these Terms & Conditions and any dispute arising from them will be governed by the laws of the State of Mississippi, United States, without regard to conflict-of-law principles.

Disputes

Before starting formal proceedings, we encourage both parties to make a reasonable good-faith effort to resolve a dispute directly.

Unless applicable law requires otherwise or the parties agree differently in writing, disputes that cannot be resolved informally will be brought before a court of competent jurisdiction in Mississippi.

Force Majeure

We will not be responsible for a delay or failure caused by events reasonably beyond our control, including major infrastructure failures, internet or hosting disruptions, natural disasters, government actions, war, civil disturbance, widespread cyber incidents or similar events.

Severability

If a provision of these terms is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

No Waiver

A delay or failure to enforce a provision does not mean that the provision or right has been permanently waived.

Assignment

You may not transfer your rights or obligations under a paid order to another party without our written consent where that transfer would include access to licensed data or other restricted materials.

Entire Agreement

These Terms & Conditions, together with the applicable quote, invoice, order confirmation, Privacy Policy and any separately signed agreement, form the agreement between you and Family Office Prospects concerning the relevant service.

Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or applicable requirements.

When we update this page, we will change the Last Updated date above. Material changes will apply prospectively to the extent required by applicable law or existing contractual commitments.
